The owner and administrator of websites is GEN-I, trgovanje in prodaja električne energije, d.o.o., Vrbina 17, 8270 Krško (hereinafter: GEN-I, d.o.o). GEN-I, d.o.o. shall strive to the best of its ability to keep the information on its websites up to date and correct. However, users of websites are warned that texts published are of an informative nature. The Company thus assumes no liability whatsoever for the accuracy, completeness and integrity of that information. Users shall use the published contents at their own risk. GEN-I, d.o.o. reserves the right to change, add or remove content on its websites at any time without prior notice, and shall not assume liability for any of the consequences of such changes.
Neither GEN-I, d.o.o. nor any other natural person or legal entity who participated in the creation and design of websites may be held liable for the temporary unavailability of websites, the inaccuracy of the information published or any damages incurred as a result of the use of incorrect or incomplete information, and thus may not be held liable for any damages or inconveniences that result from the existence of websites, access to and/or the use of and/or inability to use the information published on websites, and/or for any errors or inconsistencies in content, regardless of whether or not the user was informed about the possibility of such damages.

By entering, registering or logging into websites, web portals or web applications of GEN-I, d.o.o., a user and/or visitor confirms that they have carefully read, understand and accept in full these terms and conditions of use. These terms and conditions shall apply equally and in the same manner to users who access the websites of GEN-I, d.o.o. as unregistered visitors. The terms and conditions define the terms and conditions of the use of websites, web portals, web applications and other online content of GEN-I, d.o.o., and explain how GEN-I, d.o.o. uses personal data and cookies. The terms and conditions of the use of websites, web portals and web applications of GEN-I, d.o.o. are referred to below as terms and conditions. Websites, web activities and other web or digital services and applications of GEN-I, d.o.o. are referred to below as websites and web services, or simply as services. Users and/or visitors are referred to collectively below as ‘users’.
When visiting GEN-I, d.o.o.’s websites, and participating in web and similar activities, a user agrees in full with the terms and conditions of use. If a user does not agree with the terms and conditions, GEN-I, d.o.o. advises against the use of websites, or participation in the web activities and/or services of GEN-I, d.o.o., and recommends that the user not use or leave these sites.
In its efforts to protect its services and users, GEN-I, d.o.o. reserves the right to block or in some other way prevent the delivery of any email or other communication from or on websites, or to prevent users from breaching the rights of other persons (e.g. copyrights). GEN-I, d.o.o. may prevent the use of or terminate services using technology or other means at its disposal.
Data on websites and in web applications are strictly of an informative nature and have no legal consequences whatsoever, nor can any liability arise on the basis of such data. Moreover, such data cannot be used in proceedings to exercise or demonstrate potential rights or claims, unless expressly defined otherwise. GEN-I, d.o.o. strives for the accuracy and relevance of data published on websites or in web applications. Websites and web applications shall be used at a user’s own risk. GEN-I, d.o.o. shall not be liable for any damage that arises in connection with the existence of, access to or use of and/or inability to use websites and web applications and/or related information, or for any errors or inconsistencies in content. GEN-I, d.o.o. shall not bear any responsibility whatsoever for the smooth functioning of websites or web applications. Moreover, GEN-I, d.o.o. shall not be liable for the form and content of data obtained via links that are not owned by GEN-I, d.o.o., nor shall it be liable for the respect of privacy on those links. Websites, and web portals and applications may also contain links to other websites. When clicking such a link to the websites of GEN-I, d.o.o. or third parties, a user shall be aware that those websites have their own terms and conditions of use and personal data protection policy. Prior to the use of such sites, a user shall verify the associated terms and conditions and data protection policy. GEN-I, d.o.o. shall not assume any liability for the websites of third parties.
GEN-I, d.o.o. reserves the right to change the content of websites and web applications at any time, in any way, without reason or without stating reasons, and without prior notification. GEN-I, d.o.o. shall not assume any liability whatsoever for any of the consequences of such changes.
Personal data protection (personal data protection statement)
As a personal data controller, GEN-I, d.o.o. has prepared information for individuals whose personal data is processed. That information takes the form of terms and conditions of personal data protection, through which individuals are informed about the purposes and bases for the processing of personal data, and the exercising of their rights in connection with the processing of personal data. The terms and conditions of personal data protection also include all other required information as set out in Slovenian regulations governing personal data protection, and in Articles 13 and 14 of the General Data Protection Regulation (hereinafter: the GDPR), as well as the communications set out in Articles 15 to 22 and 34 of the GDPR in connection with the processing of personal data in a concise, transparent, intelligible and easily accessible form, using clear and plain language. The terms and conditions of personal data protection are continuously accessible at the Company’s registered office, in all organizational units and on its website at www.gen-i.si.
Login-in using a username and password is required for the use of certain elements of websites, or for participating in certain activities and using the web applications of GEN-I, d.o.o. By logging in, a user agrees that the personal data that they provided when they obtained their username and when using GEN-I, d.o.o.’s websites are used for the purposes described in these terms and conditions and in the terms and conditions of personal data protection of GEN-I, d.o.o. as data controller.
GEN-I, d.o.o. shall protect the personal data of users obtained via its websites carefully, and shall not forward that data to third parties. The personal data provided by a user when they obtain a username or use the websites of GEN-I, d.o.o. shall be processed and used for the purpose of providing GEN-I, d.o.o.’s services, for directly notifying users about new services (or the additional functionalities thereof), and for verifying whether a user uses GEN-I, d.o.o.’s websites or participates in the Company’s web activities in accordance with these terms and conditions.
Personal data obtained via GEN-I, d.o.o.’s websites will be processed in accordance with national regulations governing personal data protection and in accordance with the GDPR. At the request of law enforcement authorities, personal data, including the IP addresses of users, may be sent to the police and other competent bodies for further action in the event of abuse or breaches.
GEN-I, d.o.o. collects from the users of websites and web applications only those data that users provide the Company voluntarily, and the Company does not condition the visiting of websites on the provision of data. GEN-I, d.o.o. collects personal data only when necessary due to participation in a specific activity, where that participation and the provision of personal data are both voluntary.
For the successful management and provision of services, GEN-I, d.o.o. may collect certain information regarding users, and their use of GEN-I, d.o.o.’s websites and services, without identifying those users. A user may not be identified on the basis of those data, and GEN-I, d.o.o. may only use them for the preparation of effective services on a website or in a web application. GEN-I, d.o.o. may receive the information normally sent by a browser to every visited website, including the IP address, the type and language of a browser, time of access and website addresses. Using a tool to analyze websites, GEN-I, d.o.o. may also receive information regarding the website from which a user has visited, which search engine or engines and keywords they used to search for GEN-I, d.o.o., which pages they viewed on GEN-I, d.o.o.’s websites, and which add-ons, width and height their browser uses. GEN-I, d.o.o. shall use this information and protect the privacy thereof as described in these terms and conditions and in the terms and conditions of personal data protection of GEN-I, d.o.o. as data controller.
GEN-I, d.o.o. shall not sell, transfer or disclose the data it obtains to anyone outside of the GEN-I Group without the consent or authorization of users, unless otherwise stipulated or dictated by the law.
GEN-I, d.o.o. may process the data of individuals with whom it is in a contractual relationship to the extent required to draw up offers and contractual documentation, to fulfil contractual obligations or exercise rights from a contractual relationship, to fulfil legal obligations, on the basis of legal interests or if it has the express consent of an individual to process personal data.
Processing means any operation or set of operations that is performed in connection with personal data or sets of personal data, whether or not by automated means, such as the collection, recording, editing, structuring, storage, adaptation or alteration, retrieval, viewing, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. The personal data of individuals shall only be stored and used for the time required to achieve the purpose for which they were collected or for as long as an appropriate basis for processing exists.
A user shall be responsible for ensuring that the data they provide are accurate and up-to-date. As a personal data controller, GEN-I, d.o.o. shall, at the request of a user, supplement or correct personal data that have been determined to be incomplete, inaccurate or out-of-date, erase personal data if so requested by a user and GEN-I, d.o.o. has no legal basis for storing those data, facilitate access to the personal data of users, correct the personal data of users, and exercise all other rights of an individual stated in the terms and conditions of personal data protection of the controller. At each visit to GEN-I, d.o.o.’s websites, daily web server logs are saved automatically on the web server (IP number that identifies a specific computer or other device on the web, browser version, time of visit, etc.). GEN-I, d.o.o. shall not process data collected in this manner separately and shall not link them to other data. Daily web server logs shall be stored for three (3) months and shall then be erased.
Using an online form, it is possible to report abuse and submit comments and questions on GEN-I, d.o.o.’s websites. In such cases, the field ‘question’ must be completed. All other data are optional. However, a user may enter their name, surname and email address. GEN-I, d.o.o. needs users’ email addresses to answer questions or respond to comments, and/or inform them about findings in connection with their report. GEN-I, d.o.o. shall only process the data entered by a user in the online form if processing is required to perform its tasks and fulfil its obligations, such as the collection of reports of abuse and similar acts, and the resolution and storage (archiving) of such cases. The storage period depends on the type of procedure and the legal bases that govern the processing and storage of documentary and archive materials.
GEN-I, d.o.o. shall contact a user if the latter subscribes to the online newsletter or submits reports of abuse, questions and comments, provided that the user has provided their contact information.
GEN-I, d.o.o. shall not forward the personal data of users that it obtains from visits to its websites or subscriptions to the online newsletter to third parties. Moreover, GEN-I, d.o.o. shall not forward to others user data obtained when users log-in to or register on websites, report abuse or submit questions and comments, unless otherwise stipulated by the law.
At a user’s request in connection with data that relates to them, GEN-I, d.o.o. shall facilitate access to personal data, and the transcription, copying and extraction of personal data. It shall also send the user a list of persons to whom personal data should be sent, when, on what basis and for what purpose. At a user’s request in accordance with valid legislation, GEN-I, d.o.o. shall also provide other information in connection with the user’s personal data that it collects.
GEN-I, d.o.o. shall protect the confidentiality of the personal data of the users of its websites. GEN-I, d.o.o. shall only use collected data for the purposes for which the users of its websites submitted those data and within the framework of legal provisions. GEN-I, d.o.o. shall not use personal data and contact information for other purposes, and shall not disclose them to third parties without the express consent of the users of its website. GEN-I, d.o.o. shall do everything in its powers to protect personal data against any infringements or abuse.

Rules regarding cookies
With the aim of optimizing websites, portals or applications (hereinafter collectively referred to as: websites), in terms of system efficiency, usefulness and ensuring useful information regarding GEN-I, d.o.o.’s services, the Company automatically collects and stores information in the daily log files on a user’s computer. This information includes a user’s internet protocol (IP) address, browser type and language settings, operating system, internet service provider (ISP), and date/time of visit.
GEN-I, d.o.o. shall use these data for the effective management of websites, to learn more about the behavior of users across all websites, to analyze trends and to collect comprehensive demographic data regarding users. Collected data may be used for marketing and advertising services, and for communication (e.g. the optimization and improvement of the user experience to ensure a more attractive range of products and services). If non-personal data is used together with personal data, the former shall be treated as personal data as long as it is combined with the latter.
The provisions of these terms and conditions and the terms and conditions of personal data protection of GEN-I, d.o.o. as data controller shall also apply to data collected using cookies and other tracking techniques.
What is a ‘cookie’?
Websites, emails, web services, advertising and interactive applications may use cookies to optimize services.
A cookie is a small data file, usually containing a string of letters and numbers, that is placed on the terminal equipment (computer, mobile device, etc.; hereinafter in these terms and conditions collectively referred to as: computer) of a user when the latter visits GEN-I, d.o.o.’s websites (GEN-I, d.o.o. sends a cookie from its web server to the browser cookie file on the hard disk of a user’s computer). A cookie makes it possible for GEN-I, d.o.o.’s website to recognize user devices when a connection is made between the web server and web browser. The main purpose of a cookie is to make it possible for the web server to present a user a customized website that makes visiting GEN-I, d.o.o.’s website more personal and more responsive to an individual user’s needs. What types of cookies are used by GEN-I, d.o.o.’s?
In terms of their characteristics, GEN-I, d.o.o. may use the following types of cookies on its websites:
- temporary or session cookies: these are temporary cookies that are stored in the cookie file of a user’s browser until the end of their session (i.e. for the duration of a browser session and then deleted when that session is over). These cookies are required for the proper functioning of certain applications or functionalities on GEN-I, d.o.o.’s websites;
- persistent cookies: GEN-I, d.o.o. may use persistent cookies to improve the user experience (e.g. to store log-in information, information regarding a site’s language settings, etc.). These cookies remain in the cookie file of a user’s browser for a longer period until they are erased. That period depends on a user’s selection in their browser settings. - first-party cookies derive from a GEN-I, d.o.o. website visited by a user, and may be persistent or temporary; Websites use these cookies to store information that will be used again the next time a user visits the same site; and
- third-party cookies derive from other, partner websites (that, for example, measure traffic). GEN-I, d.o.o. may use third parties (e.g. Facebook and Google) as advertisers for the purpose of placing advertisements and optimizing market communication. Third parties such as advertisers use cookies to measure the effectiveness of advertisements, and for the purposes of customizing advertising content, analytics and improving their products. Information collected by advertisers as third parties may include data such as geographical-locational data (that, for example, derive from IP addresses) or contact details such as email addresses, if those data are collected via GEN-I, d.o.o.’s websites.
Whenever user consent is required for the use or placement of cookies, GEN-I, d.o.o. obtains user consent before use or placement on a user’s device. Whenever a website is already customized to a user or their previous settings (user account, registration, profile, etc.), obtaining consent is integrated into the user registration process.
If a user wishes to allow all three categories of cookies, they do so by clicking ‘ACCEPT ALL’. If you do not select this option, click on “COOKIE SETTINGS”' to select your preferred cookie option. Tracking and analysis
GEN-I, d.o.o. uses the Google Analytics program made by Google LLC for the continuous optimization of its websites. That program uses cookies to analyze traffic (by counting visitors, identifying browsers and key words that lead to a site, addressing navigation problems, etc.). Although this involves the use of anonymous data, a website and/or GEN-I, d.o.o. informs users about the aforementioned cookies and makes it possible for users to manage those cookies before the use or placement thereof on a user’s device (computer). A user may disable those cookies at their own discretion in cookie settings.
The use of the aforementioned cookies facilitates the tracking of online behavior; during the collection phase, cookies store information regarding how users use a website, including the number of page views, the geographic location of a user, and the time of a visit and number of visits, all with the aim of improving a website and ensuring a positive user experience. These data are collected using tracking cookies. The data obtained using cookies are anonymous and are not linked to personal data. GEN-I, d.o.o. does not share these data with third parties for their own use. If a user does not agree with the placement of such cookies, information obtained in this manner is not stored.
In accordance with the law, the technical storage of data or access thereto is only permitted for the purpose of transmitting messages via an electronic communications network or, if urgently needed, to provide information society services that a use expressly requests. GEN-I, d.o.o. uses cookies for those purpose, specifically internal session cookies for the following purposes:
- cookies for user authenticating, which are required so that a website remembers a user when they have logged into a service (i.e. when a user enters their username and password). These cookies are required for a user to gain access to restricted content. Otherwise, a user would have to log into every website sub-page. GEN-I, d.o.o. uses session cookies that are deleted when a user logs out; and
- cookies for counting the number of visitors to a site; these cookies only last as long as they are required to achieve their purpose (or for no longer than the length of a browser session) and are deleted at the end of a session.
Example of use: The ‘Remember me’ function on the Moj GEN-I portal also uses user authentication cookies, which are required so that a website remembers a user when they have logged into a service (i.e. when a user enters their username and password) and also after they have left the website (function: ‘Remember me’). A cookie is required for a user to gain access to restricted content, without having to log in when they visit the website again. GEN-I, d.o.o. uses a persistent cookie that remains in the cookie file of a user’s browser for a period of one (1) year after placement. A user must give prior consent for the use of such a cookie. If the cookie is disabled, the ‘Remember me’ function is disabled and (re)logging in is not automatic. However, the web portal and/or website continues to function without potential limits to functionality.

The users of GEN-I, d.o.o.’s websites are given the possibility of accepting or rejecting cookies on all visited websites. Copyrights
GEN-I, d.o.o. is the holder of all material and moral copyrights over content (in the broadest sense of the word, including content, texts, graphic elements, photographs, illustrations and other textual presentations, videos, music, etc.) published on its websites and/or in web applications in accordance with valid sectoral legislation governing copyrights, similar rights and intellectual property.
The content published by GEN-I, d.o.o. may only be used for personal and non-commercial purposes. Content may not be reproduced, altered, copied, republished or disseminated without the express prior consent of GEN-I, d.o.o., except in cases so permitted by the law.
If the use of content published by GEN-I, d.o.o. is permitted, all copyright and other industrial property right marks, and other notices and warnings shall be preserved. Even if a user is granted prior permission, the text ‘GEN-I, d.o.o – all rights reserved’ shall be stated on every reproduction or example of content from the aforementioned websites. Trademarks that appear on websites are registered trademarks, the holder or licensee of which is GEN-I, d.o.o. or a third party. Any use of those trademarks shall be expressly forbidden without the requisite prior written consent of the right holder. All trademarks, including those not registered as such, shall be protected by the rules of copyright law. GEN-I, d.o.o. shall actively exercise its intellectual property rights to the greatest extent allowed by the law.
If the content of services is quoted, it is permitted to create a link to GEN-I, d.o.o.’s website. Links shall not be created to pages with illegal or immoral content. The owner and/or administrator of a website on which a link is published shall remove that link at the request of GEN-I, d.o.o.
Unsolicited sending of ideas
GEN-I, d.o.o. and its employees shall not accept and shall deem all ideas sent to the Company as unsolicited, including ideas relating to new activities or services, advertising campaigns, new promotions, new products or technologies, procedures, materials, marketing plans, or the names of new services or products. GEN-I, d.o.o. asks that unsolicited ideas, presentations and other works not be sent to the Company. The purpose of these rules is for GEN-I, d.o.o. to avoid potential misunderstandings or disputes that may arise if GEN-I, d.o.o.’s services, activities, products or marketing strategies appear similar to ideas sent to the Company. GEN-I, d.o.o. therefore asks that users not send unsolicited ideas and materials to the Company or to anyone anyhow related to GEN-I, d.o.o. If users send ideas and materials despite the Company’s request not to do so, GEN-I, d.o.o. shall provide no assurances that the ideas or materials will be treated as confidential or the property of a user.
Changes to the terms and conditions
The terms and conditions have been drawn up based on currently valid legislation, taking into account the recommendations of the Information Commissioner of the Republic of Slovenia, as well as materials and other information accessible via the Information Commissioner’s web portal.
GEN-I, d.o.o. may occasionally update these terms and conditions of the use of websites in accordance with amendments to and the requirements of sectoral law, and based on changes to services and activities based on feedback from users. The date of the most recent update shall be stated at the end of the terms and conditions. In the event of material changes to the content of these terms and conditions or a change in the use of personal data, GEN-I, d.o.o. shall inform users in a conspicuous place or by informing them directly prior to the implementation of changes. GEN-I, d.o.o. recommends that users regularly review these terms and conditions, so that they will be continuously informed about the terms and conditions of use and thus how GEN-I, d.o.o. protects their privacy.

Users may request that GEN-I, d.o.o. update, correct or erase their personal data at any time (if the data in question are still in the Company’s database) or to stop using those data in the future.
